Kemenangan Bupati Johny Cabut Izin Sawit Masuk 5 Kemenangan Dunia

JAGAPAPUA.COM - Kemenangan Bupati Sorong Johny Kamuru masuk dalam 5 Kemenangan Dunia dalam publikasi National Geographic pada pada 9 Desember 2021. Kemenangan tersebut disebutkan dalam kebijakan Perlindungan Hutan (Protection of Forest) bersama Presiden Felix Tshisekedi dari Republik Demokratik Kongo dan pengadilan tertinggi Ekuador.

Dalam publikasinya, ‘5 environmental victories from 2021 that offer hope’ yakni 5 Kemenangan Lingkungan dari tahun 2021 yang menawarkan harapan' , National Geographic menyebutkan upaya perlindungan hutan di Papua Barat dimenangkan ketika pemerintah mencabut izin 12 kontrak kelapa sawit dengan luas lebih dari 660.000 acre yang setara dengan dua kali ukuran Los Angeles, California, Amerika Serikat.

“Pemerintah provinsi Papua Barat di Indonesia mencabut izin untuk 12 kontrak kelapa sawit yang mencakup lebih dari 660.000 acre (area dua kali ukuran Los Angeles), tiga perlima di antaranya masih berhutan. Kelompok hak-hak lingkungan dan adat mendesak pemerintah untuk melangkah lebih jauh dan mengakui hak-hak masyarakat adat di wilayah tersebut untuk mengelola hutan sendiri. Tiga dari 12 pemegang kontrak terus memperjuangkan keputusan pemerintah di pengadilan,” bunyi penggalan publikasi.

Bersama dengan pemerintah Papua Barat, Presiden Felix Tshisekedi dari Republik Demokratik Kongo menyerukan audit atas konsesi hutannya yang luas dan penangguhan semua “kontrak yang meragukan” sampai audit selesai pada bulan Oktober. Beberapa minggu kemudian, pemerintah mundur dari rencana untuk mencabut moratorium berusia 19 tahun atas pemberian izin penebangan baru di Hutan Cekungan Kongo.

Selain itu, kelompok atau organisasi lingkungan tetap waspada, dan Greenpeace menyerukan moratorium DRC untuk dibuat permanen.

“Kami tidak ingin ada lagi kontrak dengan mitra yang datang untuk menebang hutan kami dengan kejam; kami akan menghentikan kontrak semacam ini,” kata Menteri Lingkungan Eve Bazaiba dikutip dari National Geographic, Kamis (9/12/2021).

Selanjutnya, pengadilan tertinggi Ekuador juga telah mengeluarkan putusan yang mengamanatkan izin pertambangan dan izin lingkungan dan air di hutan harus dibatalkan.

“Pengadilan tertinggi Ekuador memutuskan bahwa rencana untuk menambang tembaga dan emas di ‘hutan awan’ yang dilindungi akan merusak keanekaragaman hayati dan melanggar hak-hak alam, yang diabadikan dalam konstitusi Ekuador,” sambungnya.

Bupati Sorong Menang atas Gugatan 2 Perusahaan Sawit

Pengadilan Tata Usaha Negara (PTUN) Jayapura menolak gugatan dua perusahaan sawit dengan Nomor 31/G/2021/PTUN.JPR dan Nomor 32/G/2021/PTUN.JPR dalam Konferensi Pers Putusan Sidang Bupati Sorong Johny Kamuru melawan Perusahaan Sawit secara virtual hari ini, Selasa (7/12).

Putusan pengadilan tersebut mengesahkan keputusan Bupati Sorong untuk mencabut Izin Usaha Perkebunan (IUP) dua perusahaan penggugat yaitu PT Papua Lestari Abadi (PLA) dan PT Sorong Agro Sawitindo (SAS).

Kedua perusahaan ini sebelumnya memiliki izin atas lahan seluas 70.000. Sementara itu, masih ada gugatan dari PT Inti Kebun Lestari yang putusannya belum dikeluarkan oleh Majelis Hakim PTUN Jayapura.

Atas putusan itu, Bupati Johny merasa bersyukur dan berharap gugatan ini menjadi pelajaran bagi semua pihak. Ia berharap ke depan, pengelolaan hutan yang berkelanjutan akan terwujud bersama masyarakat adat setempat. Hal itu juga sejalan dengan janji pemerintah untuk menghentikan konversi lahan demi mengurangi deforestasi.

“Gugatan atas pencabutan izin ini merupakan pelajaran bagi kita semua. Kemenangan ini menjadi jalan pintu masuk bagi pengelolaan hutan berkelanjutan di Tanah Papua,” ujarnya, dilansir dari mediaindonesia.com, Selasa (7/12/2021).

Di sisi lain, pengacara perusahaan sawit, Juhari, mengatakan bahwa pihak perusahaan selaku penggugat akan mengajukan banding atas putusan pengadilan tersebut. Bupati Johny mengatakan pemerintah masih berfokus pada gugatan yang ada dari PT Inti Kebun Lestari dan kemungkinan banding dari kedua perusahaan tersebut.

“Saat ini pemerintah Kabupaten Sorong fokus pada gugatan yang masih berjalan. Namun kami bersama dinas terkait sedang menyusun program-program pada prinsipnya untuk meningkatkan kesejahteraan masyarakat adat di wilayah konsesi yang izinnya telah dicabut,” sambungnya.

Sebelumnya, Bupati Sorong diketahui mengeluarkan Surat Keputusan Nomor 525/KEP.65/IV/TAHUN 2021 tentang Pencabutan Izin Usaha Perkebunan PT Papua Lestari Abadi seluas 15.631 hektare pada 27 April 2021 dan Surat Keputusan Nomor 525/KEP.64/IV/TAHUN 2021 tentang Pencabutan Izin Usaha Perkebunan PT Sorong Agro Sawitindo seluas kurang lebih 40.000 hektare pada 27 April 2021.

Selain beberapa perusahaan yang menggugat di PTUN Jayapura, juga terdapat delapan perusahaan lain yang izin mereka dicabut. Meskipun demikian, ada enam perusahaan lain yang mengembalikan wilayah konsesinya kepada pemerintah dengan sukarela.

Senator Papua Barat Desak Pemerintah Segera Sahkan RUU MHA

Senator Papua Barat, Dr. Filep Wamafma SH. M.Hum berharap persoalan pencabutan perizinan sawit oleh Bupati Sorong ini juga dapat mendorong pemerintah untuk segera mengesahkan RUU Masyarakat Hukum Adat (RUU MHA). Hal ini mengingat saat ini tidak ada lembaga negara yang secara khusus menangani masyarakat adat.

Selain itu, menurutnya, konstitusi negara juga mengakui eksistensi masyarakat adat terutama pada Pasal 18 dan Pasal 28 UUD 1945. Sehingga guna menjalankan amanat konstitusi ini dibutuhkan aturan setingkat undang-undang yang mampu menerjemahkan mandat konstitusi ini.

“Jadi, pemerintah sudah saatnya segera mengesahkan RUU MHA itu. Agar ada lembaga yang menangani persoalan-persoalan masyarakat hukum adat, ada perlindungan atas hak-hak dasar masyarakat hukum adat,” jelasnya.

Diketahui, kedua perusahaan di atas sebelumnya memiliki izin atas lahan seluas 70.000. Sementara itu, masih ada gugatan dari PT Inti Kebun Lestari yang putusannya belum dikeluarkan oleh Majelis Hakim PTUN Jayapura.

Atas putusan itu, Bupati Johny juga berharap gugatan ini menjadi pelajaran bagi semua pihak. Ia berharap ke depan, pengelolaan hutan yang berkelanjutan akan terwujud bersama masyarakat adat setempat.
