Sistem Pemilu Tetap Terbuka, MK Bakal Laporkan Denny Indrayana

JAKARTA, JAGAPAPUA.COM - Mahkamah Konstitusi (MK) akhirnya menggelar sidang pembacaan putusan terkait sistem pemilu di Gedung Mahkamah Konstitusi hari ini, Kamis (15/6/2023). Dalam sidang ini, MK memutuskan menolak permohonan judicial review terhadap pasal mengenai sistem pemilu dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu.

"Dalam provisi: Menolak permohonan provisi para pemohon. Dalam pokok permohonan: Menolak permohonan para pemohon untuk seluruhnya," kata Ketua MK Anwar Usman saat membacakan putusan.

Dengan demikian, sistem pemilu yang berlaku tetap proporsional terbuka. Dalam putusan itu, hakim MK Arief Hidayat mengajukan dissenting opinion. MK menegaskan politik uang bisa saja terjadi dalam semua sistem pemilu, baik lewat proporsional terbuka maupun proporsional tertutup.

"Pilihan terhadap sistem pemilihan apapun, sama-sama berpotensi terjadinya praktik politik uang," ujar hakim MK Saldi Isra.

Oleh sebab itu, MK lantas memerintahkan 3 langkah untuk memerangi politik uang. Pertama parpol dan anggota DPRD memperbaiki dan komitmen tidak menggunakan politik uang. Kedua penegakan hukum harus dilaksanakan tanpa membeda-bedakan latar belakangnya.

Ketiga masyarakat perlu diberikan kesadaran dan pendidikan politik tidak menerima politik uang. Hal itu tidak hanya kesadaran dan tanggung jawab pemerintah tapi juga kolektif parpol, civil society, dan masyarakat.

"Politik uang lebih karena sifatnya yang struktural, bukan karena sistem pemilu yang digunakan. Tidak bisa dijadikan dasar karena sistem pemilihan tertentu," katanya.

Sedangkan, untuk mencegah pragmatisme caleg/parpol, MK menekankan bahwa parpol harus memiliki mekanisme seperti menggunakan pemilihan pendahuluan atau mekanisme lain, bisa digunakan untuk menentukan nomor urut calon.

"Berlakunya syarat dimaksud tidak hanya didasarkan kepada kesadaran politik, namun apabila suatu waktu ke depan pembentuk UU mengagendakan revisi atas UU 7/2017, persyaratan tersebut dimasukkan dalam salah satu materi perubahan," jelasnya.

Hal ini menjawab pendapat para pemohonan yang diantara permohonannya meminta agar hakim mengubah sistem pemilu dari proporsional terbuka menjadi tertutup. Para pemohon dalam uji materi UU Nomor 7 Tahun 2017 tentang Pemilu yang diajukan pada 14 November silam dengan nomor gugatan 114/PPU-XX/2022 ini meliputi Demas Brian Wicaksono, Yuwono Pintadi, Fahrurrozi, Ibnu Rachman Jaya, Riyanto, dan Nono Marijono.

Dalam pendapatnya, para Pemohon menilai sistem pemilu proporsional terbuka akan melemahkan pelembagaan sistem kepartaian. Loyalitas calon anggota legislatif yang terpilih cenderung lemah dan tidak tertib pada garis komando partai politik.

Selain itu, para Pemohon juga berpandangan seharusnya ada kewenangan partai untuk menentukan siapa saja yang layak menjadi wakil partai di parlemen. Para Pemohon meminta kepada MK untuk membatalkan pasal-pasal yang mengatur sistem proporsional terbuka bertentangan dengan Undang-Undang Dasar 1945.

Tak hanya itu, MK juga menyikapi pernyataan Eks Wamenkumham Denny Indrayana yang sempat menghebohkan publik dengan kabar yang menyebutkan bahwa putusan MK terkait perkara tersebut bocor.

MK disebut bakal mengabulkan gugatan dan mengubah sistem pemilu dari proporsional terbuka menjadi proporsional tertutup. Pasalnya, saat itu, sidang masih bergulir dan belum mencapai babak putusan.

Oleh sebab itu, Hakim Saldi Isra menyampaikan MK akan melaporkan Denny Indrayana ke organisasi advokat yang menaunginya. Menurutnya, hal itu penting dilakukan guna menjadi pembelajaran bagi masyarakat pada umumnya.

"Kami di rapat permusyawaratan hakim sudah mengambil sikap bersama bahwa kami Mahkamah Konstitusi agar ini bisa menjadi pembelajaran untuk kita semua, akan melaporkan Denny Indrayana ke organisasi advokat yang Denny Indrayana berada," kata Hakim Saldi Isra kepada wartawan di Mahkamah Konstitusi, Jalan Medan Merdeka Barat, Jakarta Pusat, Kamis (15/6/2023).

"Jadi Itu sedang disiapkan, mungkin minggu depan akan disampaikan laporan. Biar organisasi advokatnya yang menilai, apakah yang dilakukan Denny Indrayana itu, itu melanggar etik sebagai advokat atau tidak," sambungnya.

Tak hanya itu, MK juga bakal mengirim surat ke organisasi advokat Denny Indrayana yang berada di Australia dan memilih untuk tidak melaporkan ke pihak Kepolisian. Hal itu lantaran dikabarkan sudah ada laporan kepolisian terkait masalah ini.

Sebelumnya, Denny Indrayana menyampaikan klarifikasinya pada Selasa (30/5/2023) lalu. Dirinya menegaskan bahwa informasi itu bukan diperolehnya dari internal MK.

"Ini perlu saya tegaskan, supaya tidak ada langkah mubazir melakukan pemeriksaan di lingkungan MK, padahal informasi yang saya dapat bukan dari pihak-pihak di MK," kata Denny dalam keterangan persnya. (UWR)
