JAKARTA, JAGAPAPUA.COM - Anggota Komisi III DPR RI Arsul Sani menyoroti aspek penegakkan hukum terkait dengan penetapan Organisasi Papua Merdeka (OPM) yang tidak lagi sebagai sekedar Kelompok Kriminal Bersenjata (KKB) tetapi sebagai organisasi teroris. Penetapan itu banyak mendapatkan reaksi dari sejumlah elemen masyarakat sipil yang intinya tidak setuju dengan keputusan tersebut.

“Dalam perspektif negara demokrasi, hal itu wajar dan tidak dilarang. Tetapi satu hal yang saya catat, ketika OPM ditetapkan sebagai organisasi teroris, konsen elemen masyarakat sipil mengkhawatirkan akan terjadinya pelanggaran HAM. Oleh karenanya hal inilah yang harus kita dalami secara lebih jauh," ucap Arsul dalam acara Dialektika Demokrasi yang dilaksakan di Media Center DPR RI, Kompleks Parlemen, Senayan, Jakarta, Kamis (6/5/2021).

Baginya, ditetapkan sebagai KKB atau organisasi teroris, potensi pelanggaran HAM itu tidak termaktub pada pemberian atau penetapan statusnya. Tetapi tergantung pada karakter-karakter dan juga kultur dari aparatur keamanan di Indonesia.

"Hal ini yang paling penting. Meskipun dengan status KKB, dimana dilakukan operasi penegakkan hukum yang melibatkan Polri dan TNI, kalau karakter aparatur kita yang melakukan operasi penegakkan hukum itu suka melanggar HAM, maka tetap akan terjadi juga (pelanggaran). Tetapi kita melihat, paling tidak setelah masa reformasi dan selama beberapa tahun terakhir ini, karakter itu telah berbeda dan sudah ada perubahan dari masa sebelumnya," ungkapnya.

Ia mengingatkan kepada jajaran pemerintah, ketika OPM ditetapkan sebagai organisasi atau pelaku terorisme berarti ada kerja besar yang harus dilakukan oleh institusi pemerintahan terkait. Penanganan tidak hanya terbatas pada kerja TNI dan Polri. Sistem pemberantasan terorisme di Indonesia mengacu pada pendekatan penegakkan hukum berbasis sistem tindak pidana, maka penyelesaiannya juga harus dengan proses hukum pidana.

"Buat saya, dengan penetepan sebagai organisasi teroris, pemerintah juga harus melakukan kerja-kerja pencegahan. Di dalam UU Nomor 5 Tahun 2018 disebutkan bahwa dalam rangka menangkal dan memberantas terorisme, bukan sekedar dengan menurunkan Densus 88 dan menangkapi saja, tetapi ada pekerjaan lain, yang dirumuskan dalam UU nomenklaturnya disebut sebagai kesiapsiagaan nasional yang terdiri dari kontra radikalisasi dan deradikalisasi," tegasnya.

Arsul berharap, ketika terjadi penetapan (sebagai organisasi teroris), maka jajaran pemerintahan itu juga melakukan kerja-kerja kontra radikalisasi dan deradikalisasi untuk masyarakat Papua agar tidak tertarik untuk bergabung dengan OPM itu. "Kerja dimaksud adalah kerja kemanusiaan, mulai dari percepatan pembangunan dan memperhatikan kesejahteraan," pungkasnya. (rls)
