Filep Minta Mendagri Tinjau Ulang Surat Edaran Terkait Mutasi ASN

PAPUA BARAT, JAGAPAPUA.COM - Penerbitan Surat Edaran (SE) Mendagri Nomor 821/5292/SJ pada 14 September 2022 lalu yang membolehkan pelaksana tugas (Plt), penjabat (Pj), maupun penjabat sementara (Pjs) kepala daerah untuk melakukan mutasi pegawai tanpa izin dari Kemendagri kembali menuai sorotan. Terkait hal itu, Senator Papua Barat Dr. Filep Wamafma menilai Surat Edaran tersebut secara struktural telah menerobos regulasi lainnya.

“Kita harus paham dulu kedudukan Plt, Pj, dan Pjs. Sifatnya sementara, jd akan sangat berbahaya bila keputusan yang dibuat oleh pejabat yang sementara itu memiliki dampak yang kuat bagi kebijakan strategis yang sudah dibuat oleh pejabat sebelumnya”, kata Filep saat diwawancarai di ruang kerjanya, Senin (20/3/2023).

Filep menerangkan, yang dimaksud regulasi di atasnya yakni Pasal 132A Peraturan Pemerintah (PP) Nomor 49 Tahun 2008 tentang Pemilihan, Pengesahan, Pengangkatan, dan Pemberhentian Kepala Daerah dan Wakil Kepala Daerah.

Pasal ini, lanjut Filep, menjelaskan 4 hal yang tidak boleh dilakukan Pj, yakni melakukan mutasi pegawai, membatalkan perizinan yang telah dikeluarkan pejabat sebelumnya dan/atau mengeluarkan perizinan yang bertentangan dengan yang dikeluarkan pejabat sebelumnya, membuat kebijakan tentang pemekaran daerah yang bertentangan dengan kebijakan pejabat sebelumnya, dan membuat kebijakan yang bertentangan dengan kebijakan penyelenggaraan pemerintahan dan program pembangunan pejabat sebelumnya, kecuali mendapat persetujuan tertulis dari Mendagri.

“Selain itu, perlu kita ketahui juga adanya surat kepala BKN yang menjelaskan perihal batasan kewenangan penjabat kepala daerah terkait mutasi pegawai. Tentu ini harus menjadi perhatian bersama,” kata Filep.

Adapun regulasi itu yakni Surat Kepala Badan Kepegawaian Negara bernomor K.26-304/.10 Tahun 2015, menegaskan bahwa penjabat kepala daerah tidak memiliki kewenangan mengambil atau menetapkan keputusan yang memiliki akibat hukum pada aspek kepegawaian untuk melakukan mutasi pegawai yang berupa pengangkatan, pemindahan, dan pemberhentian dalam/dari jabatan ASN, menetapkan keputusan hukuman disiplin yang berupa pembebasan dari jabatan atau pemberhentian dengan hormat tidak atas permintaan sendiri sebagai pegawai negeri sipil, kecuali setelah mendapat persetujuan tertulis dari Menteri Dalam Negeri. Berarti harus ada izin tertulis dari Mendagri.

Senator Papua Barat ini lantas menambahkan bahwa izin tertulis dari Mendagri tersebut harus terpenuhi agar keputusan yang diambil tidak berdampak negatif bagi kondisi kepegawaian di daerah.

“Keputusan tertulis dari Mendagri menjadi acuan utama supaya jangan sampai ada abuse of power dari Pj/Pjs dalam mengganti personel pegawai di daerah. Ini kan berbahaya sekali. Bisa saja hanya karena tidak suka, seorang pejabat di daerah bisa dimutasi oleh Pjs tanpa persetujuan tertulis dari Kemendagri. Lagipula sebenarnya kebijakan strategis mutasi ini kan dilarang dilakukan oleh pejabat yang cuma diberi mandat seperti Pjs ini,” ujarnya.

Senator Filep menilai SE itu bertentangan dengan Pasal 14 ayat 7 UU Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan terkait pemberhentian pegawai dan pengangkatan atau pemindahan. Pasal itu menyebutkan, “Badan atau dan atau pejabat pemerintah yang memperoleh wewenang melalui mandat, tidak berwenang mengambil keputusan dan atau tindakan yang bersifat strategis yang berdampak pada perubahan status hukum pada aspek organisasi kepegawaian dan alokasi anggaran”.

Lebih lanjut, Ketua STIH Manokwari itu menjelaskan pula bahwa sudah seharusnya ada aturan baku terkait kewenangan Pjs tersebut, yang levelnya bukan sekedar SE.

“Bagaimana mungkin SE bisa melabrak PP di atasnya? Selain itu, SE ini juga bertentangan dengan Pasal 16 UU Nomor 23 tahun 2014 tentang Pemerintahan Daerah yang menyebutkan bahwa Pemerintah pusat dalam penyelenggaraan urusan pemerintahan, berwenang untuk menetapkan norma standar prosedur kriteria dalam penyelenggaraan urusan pemerintahan. Oleh sebab itu, bagi saya, Mendagri sangat inkonsisten dan cenderung sembrono dalam mengeluarkan SE. Bisa dibayangkan satu SE bisa menghalalkan tindakan yang dilarang UU dan PP,” kata Filep.

“Terus terang, saya sangat menyayangkan hal ini. Dikhawatirkan hal ini akan juga akan mengakibatkan konflik horizontal dan vertikal di daerah. Saya berharap Mendagri bisa melihat kembali SE ini agar bisa mereduksi potensi dampak negatif yang ditimbulkan,” katanya.

Terkait hal ini, Filep pun menyampaikan apabila PNS merasa dirugikan akibat dari kebijakan Penjabat Gubernur, bupati atau walikota, maka yang bersangkutan dapat mengajukan gugatan ke Pengadilan Tata usaha Negara (PTUN). Filep menekankan, pandangan ini disampaikannya juga sebagaimana tugas pengawasan seorang anggota DPD RI terhadap undang-undang khususnya terkait dengan kepegawaian.
